This Policy does not apply to the personal information of Franchise Owners obtained outside of the Site.
By using the Site (or additional sites that we develop and display this Policy), you are agreeing to the collection, use and disclosure of your personal information as described in this Policy. If you do not agree to the collection, use and disclosure of your personal information as described in this Policy, then you should not (and please do not) use our Site.
We may obtain a variety of personal information, including (i) individual and business contact information (such as name, company name, physical address, email address, telephone number, and fax number); (ii) marital status; (iii) employment history; (iv) financial information such as the amount of money you have to invest in a franchise; (v) whether you are a military veteran; (vi) the geographic location of your mobile device if you access the Site using a mobile device; (vii) personal information of other individuals that you provide to us, such as a co-applicant; and (viii) other personal information that you may provide to us, such as through a franchise application or in communications sent to us.
In addition, when you visit our Site, we may collect certain information by automated means. The information we collect in this manner may include IP address, unique device identifier, browser characteristics, device characteristics, operating system, language preferences, referring URLs, information on actions taken, and dates and times of activity.
When you visit the Site, this information may be collected through “cookies” and “web beacons.” A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon” – also referred to as an Internet tag, pixel tag or clear GIF – links web pages or applications to web servers and may be used to transmit information back to a web server.
Through automated collection efforts, we may obtain and store “clickstream” data to tell us usage patterns. We may link certain data elements we have collected through automated means, such as your browser information, with other information obtained about you to let us know, for example, whether you have opened an email we sent to you.
We may also use third-party web analytic services on our Site, such as those of Google Analytics. These service providers help us analyze how many visitors come to the Site and use the Site. The information obtained for this purpose will be disclosed or collected directly by these providers.
The providers of third-party apps, tools, widgets and plug-ins on our Site, such as Facebook “Like” buttons, also may use automated means to collect information regarding your interactions with these features. This information is subject to the privacy policies of these providers.
We may use the information we obtain to do any of the following:
In addition, we use information collected online through cookies, web beacons and other automated means to (i) customize the user’s visit to our Site; (ii) deliver content and advertising tailored to the user’s interest; and (iii) manage our business. We may supplement data collected through automated means with information about your location to provide you with content that may be of interest to you. We also use this information to diagnose technical and service problems, administer our Site, identify users of the Site, and gather demographic information about our users. We use clickstream data to determine usage patterns and how we may tailor our Site to better meet our users’ needs.
We do not sell or otherwise share personal information about you, except as described in this Policy. We share personal information with third parties who perform services on our behalf based on our instructions. These third parties are not authorized by us to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements. We also may share your information with our area franchisees and affiliated entities Home Brands Group, LLC and Agile Building Solutions, LLC.
Information collected through third-party apps, tools, widgets and plug-ins is collected directly by the providers of these features. This information is subject to the privacy policies of the providers of the features. We are not responsible for those providers’ privacy practices.
We also may disclose information about you (i) if we are required by law, regulation or legal process (such as a court order or subpoena) to do so; (ii) in response to requests by government agencies, such as law enforcement authorities; and (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspect or actual illegal activity. We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets.
Periodically, we may supplement the information you give us with information from third parties, including our franchisees, data brokers, and other businesses. By supplementing your profile, we may be able to better provide product recommendations and special offers that will be of interest to you. We may also use this additional information to further personalize our Site and improve your experience while you are visiting our Site. Additionally, we may supplement your profile with information regarding possible franchise opportunities (for example, existing franchised businesses available for sale) in your area.
A recent addition to California law affects privacy policies. California Business & Professions Code Section 22575(b)(as amended effective January 1, 2014) provides that California residents are entitled to know how ReBath responds to “Do Not Track” browser settings. ReBath does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.
We are very concerned about safeguarding the confidentiality of your personal information. We employ reasonable administrative, physical and technological measures to protect your information from unauthorized access. Unfortunately, no web site, server or database is completely secure or “hacker proof.” As a result, while we strive to protect information transmitted on or through the Site, we cannot and do not guarantee the security of any information you provide on or through our Site, whether that information is stored on our computer systems or those maintained by others, and we also cannot guarantee that your personal information will not be disclosed, misused or lost by accident or by the unauthorized acts of others.
Our Site is neither directed nor targeted to children under the age of 13. We do not use the Site to knowingly solicit data from or market to children under the age of 13. You must be 18 years of age to join our email database.
If you are under the age of 13, please do not provide us with any personal information.
If we learn that someone under 13 has provided personally identifiable information to our Site, we will use reasonable efforts to remove that information from our databases. We reserve the right to limit participation in particular programs or promotions to visitors who are 18 year of age or older.
If visitors to our Sites send us comments, suggestions, information, ideas, concepts, content (for example, text, photos and videos), knowledge, or techniques, ReBath is free to use the information worldwide, in perpetuity, without acknowledgement or compensation, for any purpose, including developing, manufacturing or marketing products and/or modifying or improving our Site.
